Alevistar Legal Search has been retained to conduct a search for an experienced Employee Benefits Attorney to join the legal department of a growing organization that specializes in health and other types of insurance coverage. This exciting role is a newly created position and will work directly with the General Counsel and provide legal advice and support on a broad range of matters with a focus on regulatory and compliance work as it relates to health benefits plans. There will also be significant opportunities to expand your skill set and be involved with a number of other matters that come with the role of an Associate General Counsel, including, but not limited to: contract review and negotiation, litigation management, insurance coverage determinations, governance, lobbying, and strategic counseling on employment, financial and other general business matters. 

The ideal candidate will have a minimum of three years experience as an Employee Benefits attorney with a focus on health and welfare compliance either at a law firm, business or government entity. 

Responsibilities include:



·  Maintain up-to-date and accurate plan documentation for all health and welfare plans, including preparation, review and distribution of plan documents, SPDs and SBCs.



·  Provide legal advice on and ensure compliance with applicable federal and state laws/regulations, including but not limited to the Affordable Care Act, HIPAA, COBRA, GINA, MHPAEA, Section 125, etc.



·  Serve as legal advisor to operational teams responsible for administering health benefits plans, which includes providing input on and support for plan design, interpretation and administration.



·  Coordinate and oversee the annual RDS application process with CMS and Medicare Part D creditable coverage notification process in collaboration with external professional partner.



·  Coordinate and oversee annual reporting process for IRS Forms 1094 and 1095 in collaboration with external professional partner.



·  Coordinate and oversee timely distribution of required legal notices.



·  Stay current on legislative and regulatory developments in the employee benefits space and provide advice on related policy and document changes and conduct training as necessary. 



·  Collaborate with internal operations and management teams in addition to outside counsel and other external professional partners/vendors.



·  Utilize technology to enhance legal and compliance efficiencies and gain economies of scale.



Requirements:



·  JD and admitted to practice in U.S.



·  Admitted and in good standing in at least one state, preferably Pennsylvania.



·  Minimum of 3 years recent Employee Benefits experience in a law firm, corporate or government setting.



·  Thorough understanding of ERISA, Internal Revenue Code, PHSA and related laws.



·  Ability to communicate complex issues effectively in layman’s terms to all levels inside and outside the organization in writing and orally.



·  Strong analytical and writing skills.



·  Keen attention to detail.



·  Excellent communication and interpersonal skills.



·  Self-motivated and likes working in a small team environment.



·  Ability to inspire and influence employees at every level to embrace compliance initiatives. 



·  Strong analytical and legal skills, and consistent good judgment and ability to apply legal knowledge to help create practical business.
